Wixdom General Terms and Conditions (B2C)

Please read these General Terms and Conditions (hereinafter, the "GTC") carefully before accessing or using the website and, where applicable, its specific country or language versions (hereinafter, collectively, the "Platform"). These GTC govern users' access, browsing, registration and use of the Platform.

The conditions published at the time the User accesses the WIXDOM Platform and/or uses its services shall be understood to be in force.

These TyCG regulate access to and use of the services provided by Wixdom S.à r.l., a limited liability company incorporated and existing under the laws of Luxembourg, with registered office at 9, rue de Laboratoire, L-1911, Luxembourg (Luxembourg House of Financial Technology - The LHoFT), registered in the R.C.S. Luxembourg under number B721731 and with VAT number LU34722031 (hereinafter, "WIXDOM").

WIXDOM offers an analysis and data platform specialising in the crowdfunding market, providing users with access to information on crowdfunding transactions, indicators, analyses, ratings, portfolio tracking tools and, in general, market intelligence functionalities, including the use of artificial intelligence ("AI") technologies.

WIXDOM's services are for informational and general purposes only. WIXDOM does not provide individualised financial advice, make personalised investment recommendations, act as an intermediary or distributor of financial or crowdfunding products, or act as an investment services entity or participatory financing platform.

If any provision of these TyCG is declared inapplicable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining terms and obligations remain in full force and effect and binding.

1. Acceptance of the terms and conditions

  1. By registering and/or using the Platform, the user (hereinafter, the "User") accepts and agrees to comply with all the TyCG set forth in this document. Access, registration or use of the Platform implies full and unreserved acceptance of the TyCG, as well as the Privacy Policy and any other legal text published on the Platform.

  2. The User declares that they are over 18 years of age and have sufficient legal capacity to be bound by these TyCG. If you use the Platform on behalf of a legal entity (e.g. an organisation or institution), you represent and warrant that you have sufficient powers to do so and assume that the use will be in accordance with the internal rules of that entity.

  3. WIXDOM may offer different service modalities, including free access, trial versions and advanced or paid features. Certain specific services or features may be governed by Special Conditions that will be made available to the User at the time of contracting or activation and which may supplement and/or modify these TyCG.

In particular, features whose operation depends wholly or partly on language models, generative artificial intelligence systems or semi-autonomous automated processes acting on behalf of the User ("Agentic Workflows") shall be governed by their corresponding Special Conditions and may be subject to usage limits, consumption metrics and specific economic conditions.

In the event of a conflict, the Specific Conditions shall prevail over these TyCG with regard to the matters specifically regulated therein.

  3. the Specific Conditions that may be published on the Platform, where applicable; and

  4. the applicable regulations in force, in particular consumer and user regulations and information society services regulations.

  5. WIXDOM reserves the right to modify the presentation, configuration and content of the Platform, as well as the conditions necessary for its access and/or use. Access to and use of the content and services after the entry into force of such modifications shall imply acceptance thereof.

3. Purpose of the Platform and services

  1. WIXDOM provides a data and analytics platform specialising in the crowdfunding market and, in general, investment in early-stage companies, aimed at investors (retail and institutional), crowdfunding platforms, start-ups and other players in the ecosystem.

  2. Among others, the services that WIXDOM can offer the User include, but are not limited to:

  • Access to structured information on crowdfunding campaigns and operations published by third parties (crowdfunding platforms, portals, etc.).
  • Access to databases, indicators, historical series, comparisons and rankings related to campaigns, crowdfunding platforms and issuers.
  • Access to ratings, scoring models, risk and performance metrics, and other analytical outputs, which may be generated partially or entirely using artificial intelligence technologies.
  • Tools for tracking and monitoring crowdfunding investment portfolios, allowing the User to aggregate and visualise their positions in a unified manner.
  • Tools for searching, filtering and comparing campaigns, issuers and platforms.
  • Editorial content, reports, summaries, alerts and news feeds or updates related to the crowdfunding market.

The specific availability of these services and functionalities will depend on the type of access contracted by the User. In particular, certain functionalities such as automated or recurring exports, mass data extraction, programmatic access, technical integrations or other advanced functionalities may not be available in B2C mode and, where applicable, will be governed by the corresponding Specific Conditions.

  1. The services and features of the Platform may evolve, expand or change over time. WIXDOM reserves the right to introduce new features, modify or remove existing ones, as well as to offer certain services under subscription, payment or pay-per-use models, which will be governed, where applicable, by the corresponding Specific Conditions.

  2. The Platform may incorporate functionalities based on artificial intelligence and statistical models that analyse information from companies, campaigns, platforms and markets to generate ratings, estimates, scores or other indicators. The User understands and accepts that:

  • WIXDOM's AI systems operate on the basis of input data that may come from external sources and may contain errors, outdated information or inaccuracies.
  • The results generated by AI are probabilistic and estimative in nature, with no guarantee of accuracy, completeness or suitability for a specific investment.
  • These results are for informational purposes only and in no way replace the User's own analysis or independent professional advice.

Furthermore, certain functionalities may involve automated or semi-autonomous processes acting on behalf of the User. The availability, limits of use and, where applicable, economic conditions of these functionalities shall be governed by the applicable Specific Conditions.

  1. WIXDOM is not a crowdfunding platform, nor does it provide services for the reception, transmission or execution of orders, placement of financial instruments, portfolio management or individualised financial advice. WIXDOM does not intervene in the formalisation of investments, contracts or transactions between the User and third parties (crowdfunding platforms, issuers or others).

4. Registration on the Platform

  1. In order to access certain features of the Platform, the User may be required to register and create an account, providing certain identification and contact details.

  2. The User guarantees that the information provided during registration is accurate, complete and truthful. Any inaccuracy or falsehood in the information provided shall be the sole responsibility of the User.

  3. Registration as a User can be carried out:

  4. directly from the Platform, by creating an account with an email address and password; or

  5. using credentials provided by third-party digital identity providers, such as Google or Facebook, provided that these methods are enabled on the Platform.

  6. If the User decides to register or log in using Google or Facebook, they authorise WIXDOM to obtain from these providers only the information necessary to create or authenticate their account (such as name, email address and, where applicable, profile photo), in accordance with the permissions previously accepted by the User in the corresponding external service.

  7. The use of Google or Facebook registration is also subject to the terms and conditions and privacy policies of these external providers. WIXDOM does not control and is not responsible for the operation, availability, security or conditions of such third-party services.

  8. In the event that Google or Facebook restricts, suspends or deletes the User's account, or modifies the permissions granted, the User may temporarily or permanently lose access to their account on the Platform. In such a case, WIXDOM may request an alternative account verification or recovery process.

  9. The User is responsible for maintaining the confidentiality of their access credentials, regardless of the authentication method chosen, and undertakes to immediately notify WIXDOM of any unauthorised or suspicious use of their account.

  10. Any use of the Platform made using the User's credentials shall be deemed to have been made by that User, who shall be fully liable for the actions carried out under their account.

  11. WIXDOM reserves the right to reject any registration request or cancel previously accepted accounts when it considers that there has been a breach of these TyCG, a risk to the security of the Platform or an inappropriate use of the services, without this giving rise to any right to compensation.

5. Pricing policies

  1. WIXDOM offers different types of access to the Platform, which may include basic free access, trial periods and one or more payment plans with additional or advanced features ("Premium"). The specific characteristics, usage limits, prices, duration and conditions of each type will be available on the Platform at the time of purchase and will be governed, where applicable, by the corresponding Specific Conditions.

  2. Free access allows the User to use certain basic features of the Platform. Access to advanced tools, extended data, artificial intelligence-based features, language models, automated or semi-autonomous processes and other value-added services may be subject to the purchase of a Premium plan or pay-per-use billing models, in accordance with the provisions of the applicable Special Conditions.

  3. The prices of Premium services will always be clearly indicated before contracting. Unless expressly stated otherwise, prices are shown without taxes, which will be calculated and added, where applicable, in accordance with the tax regulations applicable at the place where the service is provided.

  4. Payment for Premium services will be made through the means enabled on the Platform, such as credit or debit card, external payment gateways or other means that may be enabled in the future. The use of third-party payment services may be subject to their own terms and conditions, for which WIXDOM assumes no responsibility.

  5. Unless otherwise specified in the Specific Conditions, Premium plans will be automatically renewed for successive periods equal to those initially contracted, and the corresponding amount will be automatically charged to the payment method indicated by the User. The User may deactivate automatic renewal at any time from their account, with effect at the end of the period already paid for.

  6. WIXDOM may modify the prices of Premium services at any time. If the modification affects an already active subscription, the User will be informed reasonably in advance of the next renewal. If the User does not agree with the new price, they may cancel the renewal before the date on which the change becomes applicable.

  7. Unless otherwise provided by applicable mandatory regulations or expressly stated in the Special Conditions, amounts paid are non-refundable, including those corresponding to periods not used after cancellation of the automatic renewal. In particular, amounts associated with the use of features based on artificial intelligence, language models, automated processes or credits included in the plans shall not be refundable or exchangeable for cash.

  8. WIXDOM may offer promotions, discounts, codes or special benefits, including benefits limited to certain groups or a specific number of Users. Such promotions shall be subject to specific conditions that shall be indicated at the time of the offer and must be expressly accepted by the User.

6. Licence of use and content

  1. WIXDOM grants the User a limited, personal, non-exclusive, non-sublicensable, non-transferable and revocable licence to access and use the Platform and the content available on it, exclusively for personal or individual internal use and in accordance with these TyCG.

Any reference to "unlimited" access in a service modality shall be understood to be limited to reasonable use by a natural person through the Platform's web interface and does not, under any circumstances, enable automated, systematic, intensive or equivalent uses to mass data extraction.

  1. All data, data sets, analyses, dashboards, metrics, ratings, reports, algorithms, artificial intelligence models, graphics, texts, images, code, designs and other content available on the Platform (hereinafter, the "WIXDOM Content") are the exclusive property of WIXDOM or its licensors. The User does not acquire any intellectual or industrial property rights over said Content, beyond the limited use licence expressly granted in these TyCG.

  2. It is strictly prohibited, unless expressly authorised in writing by WIXDOM, to:

  • Reproducing, copying, downloading, distributing, publicly communicating or transforming the WIXDOM Content, in whole or in part.
  • Performing reverse engineering, decompilation, mass extraction, scraping, data mining, harvesting, web crawling or any automated process on the Platform or its Content.
  • Using the WIXDOM Content for commercial or professional purposes or to provide services to third parties, including equivalent or competing services.
  • Incorporate WIXDOM Content, systematically or structurally, into your own or third-party databases.
  • Use WIXDOM Content to train external artificial intelligence models, develop derivative products or generate reusable datasets without express authorisation.
  1. If the User enters data, comments, notes, information about their portfolio or other content on the Platform ("User Content"), they declare and guarantee that they have the necessary rights to said content and that its incorporation into the Platform does not infringe the rights of third parties or applicable regulations.

The User grants WIXDOM a non-exclusive, worldwide, free licence, limited to what is strictly necessary to host, reproduce, process and display such User Content for the purpose of operating the Platform and providing the contracted services.

  1. WIXDOM may review, block or delete any User Content that it considers unlawful, contrary to these TyCG, public order, applicable regulations or the rights of third parties, without prior notice and without giving rise to any right to compensation.

  2. WIXDOM may retain User Content in aggregate or pseudonymised form for statistical purposes, service improvement, performance analysis or internal model training, always without identifying the User and in accordance with the provisions of the Privacy Policy.

  3. The licence granted under this clause shall automatically terminate in the event that the User breaches any of the obligations set forth in these TyCG, without prejudice to any legal liabilities that may arise.

7. User obligations

  1. The User undertakes to use the Platform in a diligent, lawful and respectful manner, in accordance with these GTC, applicable regulations and the principles of good faith.

  2. The User shall refrain from using the Platform for purposes or effects that are unlawful, fraudulent, harmful or that may violate the rights or interests of WIXDOM or third parties.

  3. By way of example and without limitation, the User is prohibited from:

  1. Impersonation and false information
  • Using false, incorrect, inaccurate or third-party data without authorisation.
  • Creating duplicate or multiple accounts to circumvent usage limits or fees.
  • Impersonating identities, including entities or institutional investors.
  1. Security, systems and technical use
  • Introducing viruses, malware, bots, scripts or any malicious code into the Platform.
  • Attempting to breach the security or integrity of WIXDOM's or third-party systems.
  • Performing penetration tests, reverse engineering, scans or unauthorised access.
  • Interfering in any way with the normal operation of the Platform.
  1. Scraping, data extraction and prohibited uses
  • Performing scraping, harvesting, web crawling, data mining or any automated method of data collection or extraction.
  • Downloading, copying, storing or reusing data, metrics, ratings, reports or any WIXDOM Content beyond strictly personal use through the web interface.
  • Initiating automated or recurring exports, generating structured or customised downloads, or performing systematic data extractions by any means, unless expressly permitted in the contracted modality or authorised in writing by WIXDOM.
  • Using WIXDOM Content to train third-party AI models or to develop derivative products.
  1. Unauthorised commercial use
  • Use the Platform or its content for professional or commercial purposes or to provide services to third parties without WIXDOM's authorisation.
  • Creating products, reports, dashboards or analyses that reproduce, replicate or compete with WIXDOM.
  • Distributing or reselling access to the Platform.
  1. Illegal or rights-infringing content
  • Publishing, uploading or transmitting content that is defamatory, offensive, fraudulent, misleading, violent, discriminatory, pornographic or contrary to the law.
  • Infringe on the intellectual property rights, trade secrets, privacy or data protection of third parties.
  1. Regulated financial activities
  • Using the Platform to advise third parties on investment matters.
  • Using the Platform as a professional tool to manage third-party portfolios.
  • Using WIXDOM Content to develop personalised investment recommendations for third parties.

(WIXDOM does not allow its service to be used as a tool for activities regulated under MiFID II or Regulation (EU) 2020/1503 on crowdfunding).

  1. The User shall be liable for all direct or indirect damages that their breach may cause to WIXDOM or third parties.

  2. WIXDOM reserves the right to suspend or cancel the User's account, with or without notice, when it detects:

  • breaches of these TyCG;
  • abnormal or suspicious activities or activities that affect the security of the Platform;
  • prohibited use of content or systematic extraction of data;
  • unauthorised professional, commercial or regulatory uses.
  1. Suspension or cancellation shall not entitle the User to any refund, without prejudice to the User's legally recognised rights as a consumer, where applicable.

8. Use of artificial intelligence

  1. The Platform incorporates artificial intelligence ("AI") systems and statistical models developed by WIXDOM and/or third-party technology providers, designed to process large volumes of data relating to the crowdfunding market and generate valuations. The User acknowledges that these systems operate using probabilistic methods and that their results may present variability, inaccuracies or biases inherent in the very nature of machine learning.

  2. The User understands and accepts that the results generated by AI do not constitute, under any circumstances, financial advice, personalised investment recommendations or individualised analysis, nor do they replace the professional judgement of the User or qualified advisors. The content generated by AI is for informational purposes only and should not be used as the sole basis for making investment or divestment decisions.

  3. The AI used by WIXDOM is not intended to influence the User's economic behaviour in a decisive manner or to automate decisions with legal or significant effects. Consequently, the AI systems used by WIXDOM are considered, in accordance with Regulation (EU) 2024/1689 ("European Artificial Intelligence Regulation" or "AI Act"), to be systems not classified as high risk and, therefore, subject only to the transparency and diligence obligations applicable to limited or general risk systems.

  4. WIXDOM complies with the transparency principles required by the AI Act, informing the User that certain results may have been generated or assisted by AI systems. If the Platform incorporates automated tools that generate content, summaries, predictions or other types of information using AI, the User will be clearly informed of this.

  5. The User expressly accepts that AI systems may be affected by the quality, availability, updating or integrity of the data used as inputs, which may come from external or public sources not controlled by WIXDOM. Consequently, WIXDOM does not guarantee the accuracy, completeness, timeliness, consistency or absence of errors in the results generated by AI, nor does it assume responsibility for decisions made by the User based on such results.

  6. The User understands that AI may evolve, be updated or replaced, and accepts that WIXDOM may modify, improve or withdraw AI systems or functionalities without prior notice, when it deems necessary to improve the security, quality or performance of the service or to adapt to the AI Act, its implementing rules or decisions of the competent authorities.

  7. The User undertakes not to use the results generated by AI to carry out regulated activities, provide professional services to third parties, generate financial advice, or train external AI systems without the express written authorisation of WIXDOM. Likewise, the User may not circumvent, manipulate, study or attempt to reconstruct the internal functioning of the models or algorithms used.

  8. Nothing in this clause shall limit the User's inalienable rights under applicable regulations, including those derived from the AI Act regarding the transparent and responsible use of AI systems. WIXDOM shall maintain reasonable technical and organisational measures to ensure the secure operation of its systems and to prevent their misuse.

9. Responsibilities and warranties

  1. WIXDOM shall not be liable for any information, data, metrics, ratings, analyses or any other content originating from third parties and displayed on the Platform. WIXDOM does not validate, audit or guarantee the accuracy, completeness, timeliness or truthfulness of the information obtained from crowdfunding platforms, issuers, public sources, open registries or external providers, and therefore shall not be liable, directly or indirectly, for any damages that may arise from the use of such content by the User.

  2. The data, predictions, estimates, valuations, profiles, rankings and results generated using statistical models or artificial intelligence algorithms offered by the Platform are for informational purposes only and do not constitute financial advice, personalised investment recommendations or individualised analysis. The User acknowledges that AI models may contain biases, margins of error, probabilistic inferences or methodological assumptions and that WIXDOM does not guarantee the outcome, performance or future evolution of any campaign, issuer, founder or investment.

  3. WIXDOM does not guarantee that the Platform will meet the User's expectations or that it will be suitable for the User's investment decisions or strategies. The User shall be solely responsible for their financial decisions and for interpreting, comparing and verifying the information provided by the Platform, and shall, where appropriate, seek independent professional advice. WIXDOM shall not be liable for any economic consequences, financial losses, loss of investment opportunities, loss of profits or any damage arising from the use or interpretation of the information provided.

  4. WIXDOM does not guarantee the availability, continuity or uninterrupted operation of the Platform. To the fullest extent permitted by applicable law, WIXDOM shall not be liable for any damages that may be due to technical failures, interruptions, service outages, software errors, incidents on third-party networks, scheduled maintenance or any other circumstances that affect the accessibility or operation of the Platform.

  5. WIXDOM shall not be liable for any defect, error, technical incident or operational problem affecting the Platform or the content accessible through it. Likewise, it does not guarantee that the Platform is free of viruses, malicious software or harmful elements introduced by third parties, although it declares that it has taken reasonable measures, within its capabilities and the state of the art, to reduce such risks.

  6. WIXDOM does not participate in investment or contracting operations between the User and third parties, such as crowdfunding platforms, issuers or other operators, nor does it review, validate or supervise the contractual documentation, calculations, investment terms, valuations or other elements associated with such operations. The User acknowledges that such relationships are completely unrelated to WIXDOM, which does not act as an intermediary, does not represent any of the parties and has no control over the outcome, execution or fulfilment of such transactions.

  7. WIXDOM reserves the right to remove, suspend, edit or modify the contents of the Platform, as well as to limit or prevent access to certain Users, at any time and without prior notice, when it deems it necessary to ensure the security, quality or integrity of the service, to comply with legal obligations or when it detects misuse of the Platform or a breach of these TyCG.

  8. In the event of an investigation, detection of fraud, suspicious activity or breach of these TyCG, WIXDOM may access, review, retain and, when legally required, communicate to the competent authorities any data or information that is reasonably necessary to comply with legal requirements, protect its rights or ensure the security of the Platform and Users.

10. Suspension and cancellation of services

  1. WIXDOM may temporarily suspend access to the Platform, without prior notice, when necessary to carry out maintenance, updating, repair or improvement of the systems. The User acknowledges that these interruptions are inherent in the technological operation of digital services and accepts that WIXDOM shall not be liable for any damages that such suspensions may cause.

  2. WIXDOM may limit, block or prevent access to the Platform when technical difficulties, incidents in third-party networks or systems, or any circumstances beyond its control arise that may compromise the security, integrity or proper functioning of the Platform. In such cases, WIXDOM shall act with reasonable diligence to restore the service as quickly as possible.

  3. WIXDOM shall not be liable for the lack of availability, continuity or effective functioning of the Platform when such functioning is affected by technical, operational or external causes. The User accepts that interruptions, errors or incidents inherent to the digital environment may occur that are beyond the control of WIXDOM.

  4. WIXDOM shall also not be liable for the suspension or cancellation of services when required to comply with legal or regulatory obligations or any measures taken to protect the security of the Platform, Users or third parties.

  5. In the event of force majeure, including, but not limited to, massive network failures, power outages, external attacks, cybersecurity incidents, government decisions or any unforeseeable event, WIXDOM may suspend or limit the provision of the service without any liability, always acting with reasonable diligence.

  6. The User acknowledges that the Platform contains links, accesses or integrations with third-party services or websites. WIXDOM does not control and is not responsible for the availability, operation or content of such external services, which are offered for informational purposes only.

  7. WIXDOM may unilaterally terminate the User's access to the Platform and cancel their account when it detects serious breaches of these TyCG, fraudulent use, unauthorised access, activities that compromise the security of the service or behaviour contrary to good faith or applicable regulations. In such cases, cancellation may be made without prior notice and without the right to compensation.

  8. In the event of cancellation due to breach by the User, WIXDOM may remove access to any content associated with the account and permanently block the use of the Platform. WIXDOM may retain the information strictly necessary to comply with legal obligations, prevent fraud or protect its rights.

11. Intellectual and industrial property rights

  1. The Platform, including its design, source code, architecture, interfaces, functionalities, databases, algorithms, statistical models, artificial intelligence models, data structures, ratings, reports, graphics, texts, configurations, visual content, interactive and/or elements and any other material accessible through it, is the exclusive property of WIXDOM or third parties who have authorised its use, and is protected by applicable intellectual and industrial property regulations.

  2. The User acknowledges that the reproduction, distribution, public communication, making available, transformation, extraction, reverse engineering, decompilation, disassembly, use of scraping techniques, data mining, access automation or any procedure intended to obtain the source code, logic, internal models or structure of the databases constitutes an infringement of WIXDOM's rights and is strictly prohibited.

  3. The User shall refrain from copying, storing, exporting, reusing or distributing any substantial part of WIXDOM's databases, including data, metrics, indicators, historical series, ratings, reports or any structured or semi-structured content, regardless of the means or technique used, unless expressly authorised in writing by WIXDOM.

  4. Access to the Platform does not imply, in any case, the transfer, transmission or waiver by WIXDOM of its intellectual or industrial property rights over the protected content or elements. The User is only granted a limited licence for use in accordance with the provisions of these TyCG.

  5. The logos, trade names, trademarks, distinctive signs, designs, visual identities and any other element that identifies WIXDOM or its services are the exclusive property of WIXDOM or authorised third parties, and their use by the User is prohibited unless expressly authorised in writing.

  6. Third-party content included or linked to on the Platform belongs to its respective owners, who are responsible for any issues arising from it. WIXDOM respects intellectual property rights and will act diligently in response to any indication of infringement by notifying or removing content when legally necessary.

  7. The User shall be liable to WIXDOM for any damage, loss, cost or claim arising from the unlawful, unauthorised or contrary to these TyCG use of content protected by intellectual or industrial property rights.

  8. If the User considers that any content on the Platform infringes the intellectual or industrial property rights of third parties, they must notify WIXDOM with as much information as possible so that appropriate measures can be taken.

12. Indemnity

  1. The User undertakes to hold WIXDOM, its administrators, employees, collaborators and affiliated companies harmless from any damage, loss, penalty, claim, liability, expense or cost (including legal fees and court costs or out-of-court) arising directly or indirectly from the User's use of the Platform or from a breach of these TyCG.

  2. The User shall be liable for any claim made by third parties as a result of the improper, unlawful or contrary to the TyCG use of the services or content provided by WIXDOM. This includes, without limitation, claims arising from the publication or incorporation of unauthorised information, the infringement of third-party rights, the unauthorised extraction or reuse of data, the use of content for commercial or professional purposes, or the violation of any applicable regulations.

  3. WIXDOM shall notify the User, where possible and reasonable, of any claims it may receive in relation to the misuse of the Platform and may require the User to immediately take the necessary measures to mitigate or cease the damage caused. In any case, WIXDOM reserves the right to take direct action against the User in defence of its interests and to ensure the integrity of the Platform.

  4. The obligation to compensate shall extend to any damage that WIXDOM may incur as a result of actions by the User that contravene these TyCG or infringe intellectual property rights, personal data, third-party rights or applicable regulations. This obligation shall remain in force even in the event of suspension or cancellation of the User's account.

13. Data protection

  1. The processing of the User's personal data derived from access to and use of the Platform shall be governed at all times by the provisions of WIXDOM's Privacy Policy, which shall be permanently accessible on the Platform and which the User must read and accept before registering or using the services.

  2. WIXDOM shall act as the Data Controller for the User's personal data and guarantees that such data will be processed in accordance with Regulation (EU) 2016/679 (GDPR), the applicable Luxembourg data protection regulations and any other applicable regulations in force.

  3. The main purpose of the processing will be to enable User registration, manage their account, provide access to the Platform's functionalities, develop metrics and analyses related to the use of the service, improve the User experience and send communications related to WIXDOM's services, all in accordance with the Privacy Policy.

  4. WIXDOM may use certain usage and activity data in aggregate or pseudonymised form for statistical purposes, to improve the service, to train internal models or to analyse the functioning of the Platform, without in any case personally identifying the User in such operations.

  5. The User may exercise their rights of access, rectification, erasure, restriction, objection and portability, as well as any other rights recognised by applicable regulations, through the means established in the Privacy Policy or by writing to the contact address indicated on the Platform.

  6. The use of WIXDOM technology providers located within or outside the European Economic Area may involve international data transfers, which will always be carried out with the appropriate safeguards provided for in the applicable regulations.

  7. The User declares that the data provided is accurate, complete and up to date, and undertakes to update it when necessary for the proper provision of the service.

14. Language

  1. These TyCG may be available in several languages in order to facilitate their understanding by Users. However, in the event of any discrepancy, conflicting interpretation or divergence between versions, the English version shall prevail, unless otherwise provided by the mandatory regulations applicable to the User.

  2. The User acknowledges that certain features, content, data or sections of the Platform may only be displayed in English for technical reasons, service standardisation or the availability of the information sources used by WIXDOM.

  3. Any official communication between WIXDOM and the User may be conducted in English, unless another language is expressly indicated or the User exercises rights derived from consumer regulations that require a different language in their jurisdiction.

15. Out-of-court settlement of disputes

  1. These TyCG shall be governed by and interpreted in accordance with Luxembourg law, without prejudice to the application of mandatory consumer protection regulations that may apply to the User depending on their place of habitual residence.

  2. If the User is a consumer, any dispute relating to the validity, interpretation or enforcement of these TyCG shall be submitted to the courts of the User's place of habitual residence, without prejudice to the User's right to bring proceedings before any other competent court in accordance with the applicable regulations.

  3. If the User acts as a professional or does not qualify as a consumer, the parties, expressly waiving any other jurisdiction that may apply, submit to the exclusive jurisdiction of the courts of the city of Luxembourg (Grand Duchy of Luxembourg).

  4. In accordance with Regulation (EU) No. 524/2013, WIXDOM informs the User that they may refer to the European online dispute resolution platform to attempt to resolve any dispute related to the provision of consumer services out of court. The platform is available at:
